Statement of Understanding: Alcohol and Drug Use

This statement outlines the policy of KAYAKANT LLC (DBA Kayak ANT) and its partners concerning alcohol and/or drug use on all trips and business activities along with the associated responsibilities of participants. 

1. Safety and impairment

  • Kayaking, even under ideal conditions, requires concentration, coordination, and quick decision-making.

  • Alcohol or drug consumption, even in moderate amounts, significantly impairs judgment, balance, coordination, and reaction time. This impairment poses a serious risk to participants' safety and the safety of the entire group.

  • Combining alcohol or drugs with the physical exertion, sun exposure, and dehydration inherent to kayaking can amplify its effects, leading to a greater degree of impairment than anticipated on land. 

2. Policy on alcohol and/or drug consumption

  • Zero Tolerance while Kayaking: For the safety of all participants and in accordance with best practices for water-based activities, Kayak ANT enforce a strict zero-tolerance policy for alcohol or drug consumption while actively participating in the guided kayaking portion of the tour.

  • Boating Under the Influence (BUI) Laws: Participants are reminded that operating a kayak while under the influence of alcohol or drugs is illegal in most states and under federal regulations, carrying serious penalties including fines and potential jail time.

  • Post-Kayaking Consumption: In situations where an optional social gathering is offered after the kayaking activity, responsible alcohol or legal drug consumption by legal adults may be permitted. However, participants are still responsible for their actions and well-being.

  • Prohibited Items: Glass containers are prohibited. 

3. Participant responsibilities

  • Personal Responsibility: Participants acknowledge and accept full personal responsibility for their actions and any consequences resulting from alcohol or drug consumption before or after the tour.

  • Compliance with Instructions: Participants agree to comply with all safety instructions provided by the tour guides and are responsible for informing the guides if they feel unwell or are unable to participate safely.

  • Fitness for Activity: Participants certify that they are physically and mentally able to participate in the kayaking activity and understand that consuming alcohol or drugs beforehand would compromise their ability to do so safely. 

4. Tour company liability

  • Kayak ANT are not responsible for any injury, illness, accident, or damages related to a participant's consumption of alcohol or drugs, whether at or after the event.

  • Kayak ANT reserves the right to refuse participation to anyone who appears to be under the influence of alcohol or drugs, or who is behaving in a way that endangers themselves or others.

  • In cases of disruptive or unsafe behavior due to alcohol or drug consumption, Kayak ANT may take further action, including terminating the individual's participation in the tour without refund and potentially canceling future bookings. 

By signing below, the participant acknowledges having read and understood the terms of this statement regarding alcohol and/or drug consumption on this guided kayak trip. The participant agrees to abide by these terms and accepts full responsibility for actions and decisions concerning alcohol and/or drug consumption and participation in this activity. 

By signing below, the participant further acknowledges reading and understanding the U.S. Fish and Wildlife Service's policy regarding Alcohol and Other Drugs in national wildlife refuges and parks.
